Terms of Service

1. Operator and agreement

Forma is provided by Kamil Dike Software, Robotnicza 3, 97-310 Wola Moszczenicka, Poland, NIP 7712920344, VAT registered.

By creating an account, using Forma, or purchasing a subscription, you agree to these Terms and the Privacy Policy. Mandatory consumer rights always remain unaffected.

2. Accounts

• You must provide accurate account information and keep access to your sign-in account and devices secure.
• Guest accounts are temporary until connected to a durable sign-in method. Losing a guest session may mean losing access to its data.
• You are responsible for activity performed through your account unless you promptly report unauthorized access.
• Forma is not intended for use by a person who cannot lawfully enter into the relevant agreement without a parent or guardian.

3. The service

Forma helps users create and follow training routines, record activity, schedule reminders, connect supported devices, and work with trainers. Available features may depend on the selected plan, device, browser, region, or trainer relationship.

Free, preview, and paid access may have different limits. Current features, limits, prices, currency, and billing period are shown in the app before purchase.

4. Subscriptions and payment

• Paid plans renew automatically for the selected monthly or yearly billing period until cancelled.
• Stripe processes payments. The price and currency presented at Checkout are the amount authorized for the selected billing period, subject to any tax information shown there.
• You can cancel through the billing portal. Unless the app states otherwise, cancellation stops renewal and paid access continues through the already-paid period.
• Deleting an account is different from ordinary cancellation: it cancels active subscriptions immediately and removes application data, so remaining access is not preserved.
• If payment fails, Forma may provide a limited grace period and may later restrict paid features.
• AI generation allowances reset on a rolling seven-day basis. A ten-generation credit pack is a one-time add-on for an active eligible paid plan. Credits are non-transferable, have no cash value, do not expire, and can be used only while an eligible paid plan is active.
• Purchased AI credits count successful validated drafts, not failed requests, searches, editing, or routine copies. Full refunds and disputes reverse the complete ten-credit grant and may create a negative balance that future packs offset.

5. Refunds, withdrawal, and service conformity

As a customer-friendly policy, we offer a full refund when you request it within 14 days of your first paid Forma purchase. Contact support from the email associated with the purchase. This voluntary policy does not limit any stronger statutory right.

After that period, subscription fees are generally non-refundable and we do not provide prorated refunds for unused time, except where required by law or expressly agreed.

Consumers may have a statutory right to withdraw from a distance contract and mandatory remedies when a digital service is not supplied or does not conform to the contract. Nothing in these Terms excludes rights that cannot legally be excluded, including rights to have the service brought into conformity, receive an appropriate price reduction, or terminate the contract where the law provides.

6. Trainers and clients

For trainers, the Trainer Data Processing Agreement available at https://formaroutines.com/trainer-dpa/ forms part of these Terms. By activating or using the trainer workspace, the Trainer agrees to that agreement.

• A trainer uses Forma for their own independent coaching activity. Kamil Dike Software does not employ, certify, supervise, or guarantee trainers.
• Trainers are responsible for their qualifications, instructions, client agreements, legal duties, and the lawful use of client information.
• Clients choose whether to accept a trainer invitation and may stop the connection through the available account or support process.
• Archiving a client or assignment changes access in Forma but does not necessarily delete its history.
• Plan client limits apply to active trainer relationships. Attempting to bypass those limits is prohibited.

7. Your content

You retain rights you have in routines, notes, feedback, and other content you submit. You give Kamil Dike Software a limited, non-exclusive license to host, copy, process, and display that content only as needed to operate, secure, improve, and support Forma.

Content assigned through a trainer relationship may be visible to the connected trainer or client. You must have the rights and permissions needed for anything you upload or assign.

8. Acceptable use

• Do not use Forma unlawfully, fraudulently, to harass others, or to infringe intellectual-property or privacy rights.
• Do not attempt to bypass plan limits, access another account, probe security, disrupt the service, scrape it excessively, or reverse engineer protected parts except where the law expressly permits.
• Do not upload malware or content that is illegal, dangerous, or unrelated to the ordinary use of a training service.
• Do not use Forma as emergency, diagnostic, or medical-record software, and do not enter sensitive information that is unnecessary for ordinary training.

9. Fitness and health notice

Forma provides organization and communication tools, not medical diagnosis, treatment, or emergency services. Exercise involves risk. Use appropriate judgment, follow equipment instructions, and stop if you feel pain, dizziness, or other concerning symptoms.

AI-generated routine drafts provide general exercise guidance and are not a medical service. They may be incomplete or unsuitable, must be reviewed before use or sharing, and must not be used to diagnose or treat a condition.

Consult a qualified medical or fitness professional when appropriate, especially if you have an injury, medical condition, are pregnant, or are unsure whether an exercise is suitable. Trainer content represents the trainer’s instructions, not medical advice or a guarantee from Kamil Dike Software.

10. Availability and changes

We aim to keep Forma available and secure but do not promise uninterrupted or error-free operation. Maintenance, provider failures, device limitations, or security events may temporarily affect access.

We may update features for security, legal, technical, or product reasons. Where a paid digital service is materially changed in a way that negatively affects a consumer, applicable notice and termination rights remain available.

11. Suspension, termination, and deletion

We may restrict or suspend access when reasonably necessary to protect users or the service, investigate abuse, address non-payment, or respond to a serious breach of these Terms. Where appropriate, we will give notice and an opportunity to resolve the issue.

You may stop using Forma at any time, cancel a subscription through the billing portal, and delete your account through Settings. Account deletion is permanent, cancels active subscriptions immediately, and is subject to the retention described in the Privacy Policy.

12. Responsibility

Kamil Dike Software is responsible where required by applicable law. Nothing in these Terms excludes liability or consumer remedies that cannot legally be excluded.

To the extent permitted by law, we are not responsible for independent trainer conduct, user-provided content, unsuitable exercise choices, external websites, unsupported devices, or losses caused by circumstances outside our reasonable control.

13. Governing law and disputes

These Terms are governed by Polish law. If you are a consumer, this choice does not remove mandatory protections provided by the law of your country of residence, and disputes may be brought before a court having jurisdiction under applicable consumer law.

14. Changes to these Terms

We may update these Terms when Forma, pricing, providers, or legal requirements change. The effective date above identifies the current version. Material changes will be communicated in an appropriate way before they take effect where required.
